Registration form data and use of images in our schools and educational services
I dati obbligatori non saranno comunicati ad altri soggetti e verranno conservati nei limiti previsti dalla norma di riferimento al fine di consentire la produzione di documentazione idonea in caso di richiesta da parte della P.A. o di soggetti aventi diritto. Oltre tali termini i dati verranno distrutti. In ottemperanza a provvedimenti governativi e del Ministero dell’Istruzione in merito all’attivazione di strumenti di “didattica integrata” per le scuole e “Linee Educative a Distanza” per i nidi. Ogni Istituto ha scelto di utilizzare la piattaforma Google Suite for Education o Microsft Teams.Tale piattaforma potrà essere utilizzata anche durante la didattica ordinaria per inoltrare materiale didattico o immagini a documentazione dell’attività didattica svolta. Il Registro elettronico negli Istituti dove è stato attivato è Classe Viva di Spaggiari spa il quale è stato nominato Responsabile al trattamento dati. Le password e le creazioni degli account saranno svolte con modalità che garantiscono la tutela della riservatezza e per ogni chiarimento può rivolgersi alla segreteria della scuola. In alcune scuole e servizi educativi la prenotazione dei pasti avviene attraverso una APP dedicata. La gestione degli account e dei dati avviene con le stesse modalità sopradescritte.
I dati rientranti nell’art.9 comma 1 del Regolamento Europeo (dati relativi alla salute) di Vostro/a figlio/a vengono trattati per le seguenti finalità:
- 1) adempimenti normativi per ottenere dal MIUR riconoscimento delle ore di sostegno nell’anno scolastico in corso;
- 2) redazione del PEI o PDP e di tutti i documenti necessari all’attività didattica dell’anno scolastico in corso
- 3) Gestione di diete speciali per coloro che usufruiscono del servizio mensa. Nella trasmissione dei dati al personale addetto alla cucina o ad aziende in appalto sarà conservato l’anonimato del/la bambino/a.
Il trattamento dei dati avviene sia in forma manuale che automatizzata. I dati trattati verranno conservati nei limiti previsti dalla norma di riferimento, al fine di consentire la produzione di documentazione idonea in caso di richiesta da parte della P.A. o di soggetti aventi diritto. Oltre tali termini verranno archiviati o distrutti.
Il conferimento dei dati personali raccolti per le finalità di cui ai punti a.1 e a.2 è obbligatorio pena l’impossibilità di poter procedere a dette finalità.
Oltre ai designati che operano sotto il diretto controllo della scrivente (direzione, insegnanti e segreteria della scuola), nell’ambito delle finalità di cui al punto a. i dati possono essere comunicati ad enti pubblici o pubbliche amministrazioni che ne facciano richiesta nello svolgimento di funzioni istituzionali, nei limiti stabiliti da leggi e regolamenti.
Il trattamento delle immagini potrà avvenire per finalità di documentazione didattica e promozione della scuola per 1) produrre materiale cartaceo o video esistente all’interno della scuola. Tale materiale sarà appeso negli spazi o trasmesso negli schermi dell’Istituto. Il materiale potrà essere consegnato ai genitori della classe tramite documentazione cartacea, CD, chiavetta USB, via mail o tramite programmi per trasferimento dati; 2) pubblicarle sul diario di bordo, sul sito internet e sulla piattaforma digitale della scuola e della rete Liberi di educare; 3) pubblicarle sui profili social della scuola e della rete di scuole Liberi di educare anche in occasione di eventi organizzati dalla rete per le scuole della rete (ad esempio Giocando lo sport, Miniolimpiadi); 4) documentazione fotografica di eventi scolastici o organizzati dalla rete Liberi di educare prodotta da fotografi professionisti o TV incaricati dalla scuola. Per quanto attiene i profili social le modalità di trattamento sono note e per maggiori informazioni può consultare la privacy policy dei social. Le immagini utilizzate sono pertinenti rispetto al contenuto della pubblicazione e non raffigurano elementi dai quali risultino evidenti stati di salute o altre informazioni, di carattere sensibile. Alle immagini non sarà abbinata alcuna informazione di carattere personale. La scrivente non è responsabile per l’utilizzo che terzi potranno fare delle immagini pubblicate. La base giuridica per la documentazione didattica è il consenso degli interessati e per la promozione il legittimo interesse del titolare. Le immagini saranno archiviate ed utilizzate per il periodo in cui gli alunni saranno iscritti all’Istituto/servizio educativo. Terminato il percorso scolastico le immagini saranno archiviate dall’Istituto/servizio educativo e diffuso soltanto a seguito di esplicito consenso richiesto ai genitori. In occasione di particolari uscite o eventi potranno essere sottoscritti specifici consensi, predisposti dal designato d’istituto al trattamento dati per la trasmissione di informazioni e immagini con modalità diverse da quelle indicate nella presente informativa. Le immagini, ad eccezione del punto 4 sopraindicato, saranno prodotte dalle insegnanti e dal personale della scuola.

The Ministry of Education and Merit, as Data Controller, hereby wishes to provide information about the processing of personal data of students attending this Institute, present in the School Survey - "General Data" (hereinafter Survey), provided for by the National Statistical Program (hereinafter PSN).

Purpose of processing and legal basis
The legal basis for the processing of personal data is represented by the execution of a task of public interest or public authority of the owner deriving from national legislation, in accordance with the provisions of Article 6, paragraph 1, letter e) of EU Regulation 679/2016. The processing is, in fact, aimed at collecting and disseminating the main aggregate statistical information regarding the students attending and the organization of the school. This survey (PUI00001) is provided for by the National Statistical Program (Presidential Decree approving the Psn 2020-2022. 2022 update and related lists, 11 July 2023 (published in Ordinary Supplement no. 26 to the Journal).

In particular, the obligation to provide statistical data for the Survey is provided for by art. 7 of the Legislative Decree. 6 September 1989, n. 322 and subsequent amendments and additions. The particular categories of personal data referred to in art. 9 and data relating to criminal convictions and crimes referred to in art. 10 of EU Regulation 679/2016.
Categories of data processed
The data being processed are aggregate and concern students and, in particular, the following types: (i) year of birth, year of course, sex, citizenship; (ii) disability; (iii) repetitions per year of the course (iv) attending prison schools. Furthermore, data on the organization of the school (number of classes) and on school staff (only for non-state schools) are processed.
Recipients of the treatment
The data may be communicated to subjects belonging to Sistan; to public or private entities according to the methods established by the art. 7 of the Code of ethics and good conduct for the processing of personal data for statistical and scientific research purposes, pursuant to Resolution no. 514/2018 of the Guarantor Authority for the protection of personal data.
The data is disseminated in aggregate form, so that it is not possible to trace the subjects to whom they refer.
Transfer of personal data to third countries or international organizations.
There are no transfers of personal data to third countries or international organizations.
Personal data retention period
The data collected through the Survey are stored by the Ministry of Education and Merit pursuant to art. 5 of EU Regulation 679/2016 for a period of time not exceeding that necessary for the purposes for which they were collected and subsequently processed in accordance with the provisions of the legal obligations.
Rights of interested parties
Regulation (EU) 2016/679 attributes the following rights to interested parties:
- a) right of access (art. 15), or to obtain in particular
• confirmation of the existence of personal data,
• indication of the origin and categories of personal data, the purpose and method of their processing
• the logic applied in case of processing carried out with the aid of electronic instruments,
• the identification details of the Data Controller of personal data, of the Data Processor of personal data and of the subjects or categories of subjects to whom the data have been or may be communicated,
• the retention period;
- b) right of rectification (art. 16);
- c) right to cancellation (art. 17);
- d) right to limit processing (art. 18);
- e) right to data portability (art. 20);
- -f) right of opposition (art. 21);
- -g) right not to be subjected to a decision based solely on processing that similarly significantly affects them (art. 22).

Right to Complaint
Interested parties in the event that they believe that the processing of the personal data relating to them has been completed
in violation of the provisions of EU Regulation 679/2016 have the right to lodge a complaint with the Guarantor, as provided for by the art. 77 of EU Regulation 679/2016 itself, or to take action in the appropriate judicial offices pursuant to art. 79 of EU Regulation 679/2016.
Source from which the personal data originates and the methods of processing for which the data are intended
State and non-state educational institutions and CPIAs compile the Survey on the Sidi portal of the Ministry of Education and Merit, pre-loading in summary form the data already present in the administrative source National Student Registry. Furthermore, they enter additional data, always in aggregate form, referring to those attending, the staff (non-state schools only), the structure and the services offered by the school.
The processing activities are carried out through the use of ICT services, office automation tools and, where necessary, with manual management.
